In the United Kingdom, the term ‘lawyer’ is a general term used to describe any Licensed Legal Practitioner who is qualified to provide legal advice in one or more areas of law. This includes solicitors, barristers and chartered legal executive (CILEX). While Solicitors and Barristers often work closely together there are several key distinctions between their roles and responsibilities.
Lawyers in the UK are regulated by their own independent bodies, who are responsible for setting out the rules, code of conduct and professional standards which they are required to maintain and follow. They also ensure that Lawyers are insured which offers protection to their clients. Solicitors are regulated by the Solicitors Regulation Authority (SRA). Barristers are regulated by the Bar Standards Board (BSB) and Chartered Legal Executives are regulated by CILEX Regulation.
There is also a difference in the qualification routes to qualify as a lawyer in the UK. Solicitors must pass the Solicitors Qualifying Exam (SQE). Barristers must complete the Bar Training Course and be called to the Bar by one of the Inn of Court. Chartered Legal Executives must complete the CILEX qualifications and training. There is also a difference is their courtroom attire. Solicitors are required to wear business attire whereas barristers are required to wear a gown and wig.
A Solicitor is a qualified legal professional who is typically the first point of contact for individuals or businesses seeking legal advice. They work closely with clients, taking instructions and advising clients on their legal rights and obligations, draft legal document and carry out legal research and case preparation. Some solicitors may specialise in multiple areas of law or specialise in just one specific area, such as family or criminal law. Solicitors usually work in law firms or businesses.
If a case needs to go to court, a solicitor can represent their clients if they are granted ‘rights of audience’. Otherwise, they will instruct a barrister to act on behalf of a client. The solicitor would prepare the case for the barrister.
Barristers specialise in courtroom advocacy and provide legal advice in an area they specialise in. They are often instructed by solicitors to represent clients in court. Barristers advocate on behalf of their client in court by presenting their case, doing cross examinations, and negotiating with the other side. Barristers are either self-employed and work in chambers or work for organisations.
