Yes, you can sue for Defamation in the UK.

Defamation of Character is a legal action intended to protect your reputation from harm, governed by the Defamation Act 2013.[1]

What are the two types of Defamation?

  • Libel is where defamatory statements are made towards you in a permanent form. This can be in writing such as printed text messages and comments or statements posted on social media.[2]
  • Slander is another form, involving temporary statements made towards you such as spoken words, gestures[3] or conduct[4].

What are the requirements to establish a Defamation Claim?

A claim for deformation has to be brought within one year of the date of the defamatory statement being made.[5]

 To bring a defamation claim you must establish the following elements:

  • Defamatory statement: You must prove a false statement was made.
  • Identification: The statement must identify you directly or by implication.[6]
  • Publication: The statement was communicated to a third party.[7]                             
  • Serious Harm: You must prove the statement caused or likely to cause serious harm to your reputation.[8] If your business or other profit-making entity brings a claim you must prove the statement caused or likely to cause “serious financial loss”[9]

Who can you bring a Defamation Claim against?

Any:

  • Individuals,
  • Businesses or
  • Other legal bodies.

 All parties involved in the publication of the defamatory statement can be sued, including the actual author, person who made the statement, the editor or the publishing company.[10]

In certain circumstances, additional parties such as distributors of defamatory material can be sued including website owners and ISPs but website operators have certain protections if they were not responsible for the publication.[11]
