Boundary disputes can be complex and finding yourself amidst a dispute can be both stressful and worrying. You may be torn between maintaining cordial neighbour relations and protecting and preserving the extent of your property.
In the UK, registered property boundaries are generally unidentified with the exception of the property’s title plan which indicatively delineates the ‘general boundary’. It can therefore be difficult to establish a precise boundary in measurable units, which can give rise to ambiguity as to where your boundary is or even encroachment onto your property by a neighbour who may consider or try to claim your property to be theirs, or maybe you have purchased a property believing you own a portion of land which you later discover may not be included in your title.
It is important to seek legal advice if you find yourself in a boundary dispute sooner rather than later to prevent (1) Escalating tensions with your neighbours, (2) action by your neighbour who may attempt to alter features of the boundary/the boundary itself, (3) a potential claim by your neighbour that they possess legal ownership of the land in dispute by way of their uninterrupted use of the land.
We are experienced in helping property owners try to resolve their boundary disputes, and in the first instance, we are always keen to approach a dispute with evidence-based information to achieve a positive resolution.
